Promotor argumenta que as despesas de todas as festas de Ano-Novo da atual gestão foram questionadas na Justiça
O Ministério Público (MP) Estadual, está recomendando a prefeita de Fortaleza, Luizianne Lins, e a secretária de turismo do município, Patrícia Aguiar, no sentido de cumprirem as orientações do Tribunal de Contas dos Municípios (TCM) quanto a realização de despesas com a festa de passagem de ano. Na próxima semana, nos dias 17 e 18, a Prefeitura vai proceder a abertura das proposta das concorrências para a estrutura dos palcos e shows pirotécnicos no aterro da Praia de Iracema e nos polos de Messejana e do Conjunto Ceará.
O documento, encaminhado pelo promotor Ricardo Rocha, titular da Promotoria de Justiça de Defesa do Patrimônio Público, foi recebido pela secretária Patrícia Aguiar no dia primeiro deste mês, mas o assessor jurídico da prefeita, Fernando Cavalcante, recusou-se a receber a recomendação dirigida à prefeita Luizianne.
A secretária de Turismo do Município de Fortaleza, Patrícia Aguiar, fez um contato com o promotor Ricardo Rocha, demonstrando interesse em se reunir porque pretende que todo o processo seja desenvolvido sem nenhuma irregularidade. A data dessa reunião, no entanto, ainda não foi marcada.
Responsabilidade
A recomendação dirigida à secretária é para que as orientações do TCM sejam cumpridas "e os fatos anteriores não se repitam, preservando-se assim o patrimônio público do município de Fortaleza".
No documento dirigido à prefeita, o promotor Ricardo Rocha recomenda que ela assuma pessoalmente a gestão das despesas a serem realizadas para a festa réveillon 2011/2012, se responsabilizando por todos os atos, de forma que os fatos anteriores não se repitam.
O promotor Ricardo Rocha justifica a recomendação, considerando que as despesas de todas as festas de réveillon realizadas pela atual administração foram questionadas na Justiça, e as da última (2010/2011) são alvo de procedimento em trâmite no MP Estadual.
Ilegalidades
Ressalta ainda que os questionamentos giram em torno de supostas ilegalidades cometidas na contratação das empresas que promoveram os eventos, com dispensa de licitação indevida e outras apontadas nas ações ajuizadas.
Diz também que, na avaliação do Ministério Público, as festas anteriores trouxeram sérios prejuízos ao patrimônio público de Fortaleza. Por fim, lembra que a prefeita Luizianne foi eleita para representar o povo da cidade e cuidar bem do seu patrimônio.
No dia primeiro de junho deste ano, a primeira câmara de julgamentos do TCM julgou irregulares as despesas do réveillon 2006/2007, apontando o então secretário de turismo, Henrique Sérgio Abreu, como único responsável por um débito de R$ 548.405, e multa de R$ 14.897.
Uma semana antes, a mesma câmara, ao julgar as contas do réveillon 2007/2008, aplicou multa e débito no valor de R$ 322.669. No réveillon 2008/ 2009 também surgiram problemas e, por meio de um mandado de segurança interposto por uma das empresas concorrentes, a Justiça chegou a suspender o certame.
O presidente do Tribunal de Contas dos Municípios, Manoel Veras, ao ser abordado sobre o réveillon 2011/2012, disse que havia recebido os editais de licitação e encaminhado ao setor competente para análise. Ele espera não haver problemas neste ano, em função da experiência já acumulada pela atual gestão em licitações dessa naturez
