Ministério Público denuncia Luizianne Lins e assessores; cargo da prefeita pode entrar em risco

O Ministério Público do Ceará (MP/CE) por meio da Procuradoria dos Crimes Contra a Administração Pública (PCCAP) e da Promotoria de Justiça, ajuizou uma denúncia-crime no Tribunal de Justiça do Ceará (TJ/CE) e uma Ação Civil Pública por Ato de Improbidade Administrativa, no Fórum Clóvis Beviláqua, contra a prefeita de Fortaleza, Luizianne de Oliveira Lins, e mais duas assessoras, Helena Rodrigues Barroso, coordenadora do Gabinete e Nágela Raposo Alves, sua assessora institucional.
O procurador de Justiça Ricardo de Lima Rocha disse ao Diário do Nordeste Online que as investigações estavam sendo realizadas pelo Tribunal de Contas do Município (TCM) desde 2007. Na ocasião, a prefeita Luizianne e suas assessoras teriam usado cartões corporativos de forma indevida. “O TCM julgou uma série de irregularidades contra a prefeita e suas assessoras. Entre elas gastos com SPA na Itália e passagens aéreas”, afirma o procurador.
Entre as acusações contra Luizianne Lins está uma viagem para Itália. Segundo Ricardo de Lima foi concedido o direito de uma viagem para Salvador, onde a prefeita participaria de um evento, mas neste período, de 15 a 17 de outubro de2007, a prefeita estava na Itália. Na ocasião, também foi registrado uso do cartão em lojas. O MP/CE afirma que questionadas pelo Tribunal de Contas dos Municípios sobre a ilegalidade das despesas, ainda tentaram se redimir devolvendo parte do dinheiro, o que não as livra da prática do crime e do ato de improbidade, remanescendo, porém, valores não devolvidos.
Julgamento
Na Ação Civil Pública, é requerido a perda da função pública de Luizianne de Lins – de prefeita Municipal de Fortaleza; de Helena Rodrigues Barroso, de coordenadora do Gabinete; de Nágela Raposo, de assessora Institucional. Além disso, as envolvidas podem ter a suspensão dos direitos políticos de oito a dez anos.
O MP também exige o ressarcimento integral do dano causado ao Erário Público Municipal no valor total atualizado de R$ 37.924,47, sendo R$ 31.627,91 de responsabilidade da própria prefeita; R$ 962,76 de Nágela Raposo e R$ 5.333,80 de Helena Rodrigues. Além disso o Ministério requer o pagamento de multa civil de até três vezes o valor do acréscimo patrimonial, assim considerado o valor a ser ressarcido, requerido acima, bem como a proibição a todas as rés de contratar com o Poder Público ou receber benefícios ou incentivos fiscais ou creditícios, direta ou indiretamente, ainda que por intermédio de pessoa jurídica da qual seja sócio majoritário, pelo prazo de dez anos, tudo de conformidade com o que determina o art. 12, Inciso II e III da Lei n.º 8.429 de 02 de junho de 1992.
A denúncia-crime, assinada pelo coordenador da PROCAP, Benon Linhares Neto, requer a condenação das denunciadas, a prefeita Municipal Luizianne Oliveira Lins nas sanções preconizadas no artigo 1º, incisos V e VII do Decreto-Lei 201/67 e as assessoras Helena Rodrigues Barroso e Nágela Raposo Alves, nos crimes previstos nos artigos 315 e 319 do Código Penal Brasileiro.

O Diário do Nordeste Online procurou o advogado Elionaldo Cruz, que é responsável pela defesa da Prefeitura, mas o mesmo encontrava-se com o celular desligado.
